Should I Keep My Workers’ Comp Lawyer?

At the law office of Jay Gervasi, P.A., we recognize how difficult it can be to evaluate the available information and decide on the right lawyer for you. Should I Keep My Workers’ Compensation Lawyer?

The law does not require that you continue to work with the same workers’ compensation lawyer throughout the duration of your case. Injured people do not always choose the best lawyers to represent them at first. Most highly qualified workers’ compensation lawyers have seen instances in which an injured worker picked the wrong one. However, lawyers should generally avoid encouraging injured people to “change horses in midstream,” as that can disrupt representation and result in less effective service to clients. There are times, though, when a client should change lawyers, and he or she has the right to do that.

Jay Gervasi, P.A., occasionally receives calls from injured workers who are dissatisfied with their lawyers. The most common root of complaints is a perception of lack of communication. In those instances, the caller is generally advised to make an appointment with the current lawyer to address the concern, after which the client is usually satisfied. It is a reality of law practice that many lawyers, even very good ones, tend to overload themselves with work so that they do not communicate as well with their clients as they would like. While that is not an excuse for poor communication, it may be the explanation for it and is often something that can be resolved.
